A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant of "2019 Highest 1448" is an employer who runs a construction business with ten full-time workers at E Co., Ltd. in substantial D of Cheongju-si.

When a worker dies or retires, the employer shall pay the wages, compensations, and other money and valuables within fourteen days after the cause for such payment occurred.

Provided, That in special circumstances, the date may be extended by mutual agreement between the parties.

Nevertheless, the Defendant did not pay 58,48,959 won (excluding B and C have expressed their intention not to punish) in total for 58,488,959 won (excluding KRW 72,236,341 won-6,810,812 won-6,936,570) as stated in the attached list of crimes, including that the Defendant did not pay 2,970,844 won in April 1, 2017 G, which worked in the F construction site located in Sejong-si from April 1, 2017 to June 30, 2017, for the extension of the payment date, within 14 days from the date of retirement without agreement between the parties concerned.

The defendant of "2019 Highest 2681" is the representative director of the E corporation located in the substantial area of the Chungcheongbuk-si, Cheongju-si, and is the user who engages in construction business (for items: Saturdays) by using three regular workers.

When a worker dies or retires, the employer shall pay the wages, compensations, and all other money and valuables within fourteen days after the cause for such payment occurred.

Provided, That the date may be extended by mutual agreement between the parties in extenuating circumstances.

Nevertheless, the Defendant agreed to extend the amount of KRW 4,750,00 paid in July 1, 2017 by the J, who worked from October 17, 2016 to July 15, 2017 at the site of the construction of the H building in Sejong-si, as wages of KRW 3,420,000, and KRW 14,345,000 paid in May 2017 by the J, who worked from November 20 to May 20, 2017 at the site of the construction of the H building in Sejong-si, from December 1, 2016 to July 15, 2017.
