The prosecution of this case is dismissed.

1. Around 00:05 on November 7, 2013, the Defendant, within a district located in Jung-gu Incheon, Jung-gu, Incheon, and seven police officers of that police officer, the Defendant publicly insultingd the victim D by stating that “Is the victim D, “Is the spath of drinking water, as Ispath. B, Ispath, as Ispath. B, Ispath, as Ispath. B, as Ispath, Ispath, and Ispath.”

2. The facts charged in the instant case are crimes falling under Article 311 of the Criminal Act, and can be prosecuted for the victim’s accusation pursuant to Article 312(1) of the Criminal Act. According to the records, the victim submitted a letter of withdrawal of complaint on January 15, 2014, which was subsequent to the institution of the instant indictment. Thus, the prosecution in the instant case is dismissed pursuant to Article 327 subparag. 5 of the Criminal Procedure Act.
