A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Violence;

가. 피고인은 2011. 10. 28.경 김포시 풍무동에 있는 풍무중학교 운동장에서 피해자 B(14세)이 피고인의 여자 친구 엉덩이를 만졌다는 소문을 듣고 이에 화가 나 주먹으로 피해자의 얼굴을 수 회 때리고, 발로 피해자의 몸통 부위를 수 회 걷어찬 후, 근처인 김포시 풍무동 범양산길 으슥한 곳으로 데리고 가 그 곳에서 위와 같이 재차 주먹과 발로 피해자의 얼굴과 몸통 부위를 수 회 때려 폭행하였다.

나. 피고인은 2011. 11. 1.경 김포시 풍무동에 있는 풍무중학교 운동장에서 피해자를 만나 근처인 김포시 풍무동 범양산길 으슥한 곳으로 데리고 가 그 곳에서 위와 같이 주먹과 발로 피해자의 얼굴과 몸통 부위를 수 회 때려 폭행하였다.

2. 폭력행위등처벌에관한법률위반(공동폭행) 피고인과 C은 2011. 10. 31.경 김포시 풍무동에 있는 풍무중학교 운동장에서 위 피해자를 만나 김포시 풍무동에 있는 범양산길 으슥한 곳으로 데리고 간 다음 피고인은 주먹으로 피해자의 얼굴을 수 회 때리고, 속칭 ‘엎드려뻗쳐’를 시킨 상태에서 발로 피해자의 몸통 부위를 수 회 때리고, C은 이에 합세하여 발로 피해자의 몸통, 팔 부위를 약 5회 걷어찼다.

Accordingly, the defendant and C jointly assaulted the victim.

3.
