A defendant shall be punished by imprisonment for three years.

However, the execution of the above punishment shall be suspended for five years from the date this judgment becomes final and conclusive.

Punishment of the crime

After the death of the spouse, the Defendant married all of the children other than the victim C (math, 35 years of age) who is married to the second male and female of 20 years of age after the death of the spouse, and got married to the victim from around 2006, and the victim is a disabled person of 3rd degree of liver disability.

The Defendant had the intent to have sexual intercourse with the victim by force by using the fact that the victim is unable to maintain his/her independent daily life and livelihood without his/her guardian, such as having lost his/her mind several times during one month due to the severe comparity of sexual intercourse, and actively resisting or reporting the sexual characteristics of his/her family relationship.

1. On December 201, 201, at around 23:00, the Defendant: (a) covered the instant payment with the victim at the Defendant’s house located in Busan Jung-gu Do Manionion 109, Busan Jung-gu; (b) predicted the television to contact with each other; and (c) exceeded the panty of another victim on the part of the refused victim; and (d) exceeded the panty of the other victim on the part of the other victim; and (e) was in one-time sexual relationship with the victim by inserting his sexual organ into the part of the victim.

Accordingly, the defendant has sexual intercourse with the victim who has a physical disability by force.

2. At first 23:00 on December 2013, the Defendant: (a) exceeded the panty of the victim who was found to be television at the above Defendant’s office; and (b) exceeded the panty of the victim refusing to do so; and (c) was sexually related with the victim once by inserting his or her sexual organ into the panty part of the other victim’s sexual organ on the part of the victim.

Accordingly, the defendant has sexual intercourse with the victim who has a physical disability by force.

3. At around January 2, 2014, the Defendant: (a) 23:20, at the front door of the above Defendant’s house, she opened television to the victim’s house, and then she she steed off the victim “at one time,” and she exceeded the panty of the victim refusing to do so; and (b) she was sexually related with the victim once by inserting her sexual organ into the sound part of the victim.
