The defendant paid KRW 7,00,000 to the plaintiff and 5% per annum from March 14, 2020 to October 14, 2020.

1. Facts of recognition;

A. The Plaintiff and Nonparty C are legally married couple who completed the marriage report on March 28, 1976.

나. C은 2018. 3.경 병원에서 입원치료를 받으면서 피고를 알게 되어, 그 무렵부터 연락을 주고 받으면서 만남을 유지하였고, 피고는 2019. 9.경 C에게 “아저씨 오늘도 힘내시고 제가 많이 사랑합니다♡♡♡”, “보고 싶어도 못보니 아저씨 우리 꿈속에서 꼭 만나요. 정말 보고 싶습니다. 많이요”, “오늘은 전화통화하기 어렵겠네요. 모든 것이 다 멈춰버린 느낌. 우린 뭐 이런 사랑을 하고 있는지요. 한 사람은 담 속에 갇혀 있고. 한 사람은 머나먼 거리에서 애절하게 보고 싶어하는”이라는 카카오톡 메시지를 보내기도 하였다.

2. Determination

(a) An act of a third party who causes damage to a spouse by committing an unlawful act with the spouse, thereby infringing on or interfering with the common life of the married couple falling under the essence of the marriage and infringing on the spouse's right as the spouse, thereby causing mental pain to the spouse, constitutes a tort in principle.

(see Supreme Court en banc Decision 2011Meu2997, Nov. 20, 2014). “Cheating” in this context refers to a broad concept, including the adultery, which does not reach the common sense but does not reach the common sense, and includes any unlawful act that is not faithful to the husband’s duty of mutual assistance. Whether it is an unlawful act or not should be assessed in consideration of the degree and circumstances depending on the specific case.

In light of the above legal principles, the health care unit as to the instant case, and according to the above facts acknowledged, the Defendant, knowing that C is a spouse, commits an unlawful act with C, thereby making a marital life falling under the essence of marriage.
