Defendant shall be punished by a fine of KRW 3,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

1. At around 11:40 on March 23, 2019, the Defendant: (a) acquired a victim’s check, the market value of which the victim D lost before Bupyeong-gu Incheon, Bupyeong-gu, Seoul; and (b) one bank check, one agricultural credit card, and one resident registration certificate.

The Defendant, without taking necessary procedures such as returning the above acquired property to the victim, embezzled it on his own idea.

2. Fraud and violation of the Specialized Credit Finance Business Act;

A. At around 11:49 on March 23, 2019, the Defendant: (a) presented the above bank body card in the above name D, which was obtained as described in paragraph (1), to the victim as if the Defendant was D; (b) had the victim pay one commodity amounting to KRW 30,000 from the victim; and (c) used the lost body card.

B. On March 23, 2019, at around 12:04, the Defendant committed the crime in G, the second floor of the 2nd floor in the operation of the victim’s name in Bupyeong-gu Incheon, Bupyeong-gu, Incheon. At around 6, 2019, the Defendant: (a) presented the bank body card in the above name D as indicated in paragraph (1) to H as if the Defendant was D, and presented it to H, an employee of the above G, and used the lost body card to pay the amount of 7,000 won equivalent to the market value of H; and (b) used the lost body card.

C. At around 12:38, 2019, the Defendant committed the crime at the “I” mobile phone sales store on the first floor in the K Station of the victim J in Bupyeong-gu Incheon, Bupyeong-gu, Incheon, with the victim’s operation, and the above bank ccarmers of the above D, as stated in paragraph (1), presented the victim as if the Defendant was D, and presented it to the victim, so that the victim can settle the payment of one unit of the LG smartphone’s mobile phone amounting to KRW 50,000 at the market price, and used the lost cam card.
