타인의 등록상표와 동일한 상표를 그 지정상품과 동일 또는 유사한 상품에 사용하거나 타인의 등록상표와 유사한 상표를 그 지정상품과 동일 또는 유사한 상품에 사용하여서는 아니됨에도 불구하고, 피고인은 인천 남구 C아파트 103동 2203호 소재에 2012. 12. 17부터 통신판매업신고(D)를 하고 인터넷 네이버앤샵에 입점하여 E라는 인터넷판매업신고를 하고 영업 중에 있는 자로, 2013. 10월경부터 2013. 12. 20. 사이 자신이 운영하는 인터넷 쇼핑사이트인 E에 1987. 01. 19 특허청에(상표등록번호 F) 등록된 ‘G' 상표의 목걸이를 425,800원에 판매를 한다며 H이라는 해외인터넷 사이트에서 복사를 해 와 구글번역기를 통해 내용을 번역한 뒤에 한글로 18금 ’G‘라고 판매할 목적으로 광고함으로서 등록상표와 유사한 상표를 그 지정상품과 동일 또는 유사한 상품에 사용하여 침해하였다.
