Reasons
Punishment of the crime
1. Violation of the Act on Special Cases Concerning the Settlement of Traffic Accidents (Bodily Injury) is a person who is engaged in driving a FIE car.
On July 29, 2017, the Defendant driven the said car under the influence of alcohol level of 0.141% from blood alcohol level around 06:10 on July 29, 2017, and led to driving of the said car at approximately 80 km per hour in the direction of tolerance from Gwangju-si to Gwangju-si Station.
At the time, the Defendant was followed by the H SP car driven by the victim G (60). In such a case, the Defendant had a duty of care to live well on the front side and secure and proceed safety distance with the front line with the front line.
Nevertheless, the Defendant was negligent in driving while driving a car at a roadside, and the Defendant did not find out the stopping of the car in accordance with the stop signals, and was negligent in driving the car at the same time, and received the front of the car driving by the Defendant after driving the car at the same time.
