1. Defendant A

A. The above defendant shall be punished by imprisonment with prison labor for 10 months and fine for 400,000 won.

1. The Defendants’ co-offenders are two-dong-dong-dong-dong-dong-dong and are not aware of the victim D(39 years of age).

피고인들은 2016. 4. 3. 02:50경 서울 도봉구 E에 있는 F 휴대폰 대리점 앞길에서 성명불상의 동네 후배 3명과 함께 술에 취하여 소란을 피우다가 112신고를 받고 출동한 순찰차를 향해 술에 취한 상태의 피해자가 “다 잡아가라”라고 소리쳤다는 이유로 화가 나, 같은 날 03:13경 순찰차가 철수하자 피고인 B은 피해자에게 다가가 “네가 신고 했냐”라고 따지며 주먹으로 피해자의 얼굴을 수회 때리고, 피고인 A는 이에 가세하여 주먹으로 피해자의 얼굴을 수회 때려 피해자를 땅에 넘어뜨린 후, 피고인들은 계속하여 땅에 넘어져 있는 피해자의 얼굴과 온 몸을 주먹과 발로 20여회 때리고 찼다.
