그럼에도 피고인은 술에 취하여 이를 게을리한 채 전방을 제대로 잘 살피고 않고 그대로 진행하다가 같은 차로에서 앞서 가던 피해자 운전의 위 화물차를 뒤늦게 발견하고 이를 피하기 위하여 급제동하였으나 미처 피하지 못하고 위 화물차의 뒷부분을 피고인 운전 차량의 앞부분으로 들이받아 그 충격으로 위 화물차가 좌측으로 튕겨나가 도로의 중앙분리대를 충돌하고 이어 우측으로 튕겨나가 도로의 가드레일을 충돌하여 전도되게 하였다.
