The defendant shall be innocent.

1. On March 5, 2014, the Defendant: (a) at the office of the injured party E (Representative F) in Seocho-gu Seoul Seocho-gu Seoul Metropolitan Government D D Building, the Defendant was delegated to G, the employees of the injured party’s company, the “H panty Spanishing Asia,” which was held at around around August 2014, and invested the expenses incurred in the course of the event, the Defendant will return the investment amount clearly; and (b) divide the half of the profits, if any.

A false statement was made to the effect that “I will send the H’s contribution contract three days after the deposit of the investment amount.”

The facts were that the Defendant was unable to obtain any authority over the H panty exercise at the time, and even if having received such investment, the Defendant did not have any intent or ability to make the victim gain profits by proceeding the above panty holding event.

Accordingly, the Defendant, by deceiving G, received delivery from the victim company of KRW 10 million on March 5, 2014, and KRW 66,500,00 on March 10, 2014.

2. Determination:

A. According to the evidence duly admitted and examined by this court, the following facts can be acknowledged.

① On November 1, 2013, the information that the K-in-house director of the K-in-house K-in-house K-in-house K-in-house K-in-house K- in the KBS L-in-house K-in-house K-in-house K- in the KBS L-in-house K-in-house K-in-house K-in-house L in the KBS (hereinafter referred to as “M” ; hereinafter referred to as “K”) requested the K-in-house K-in-house K-in-house K-in-house K-in-law to address and proceed with the interest thereof (K’s legal statement). ② On December 19, 2013, M-in-law’s personnelO (P) sent to the Defendant an e-mail on the hin-out-out-out budget, and sent the Defendant the e-mail-in-house K-in-out 1 to 30/415 of the investigation records.
