피고인은 2015. 6. 23. 13:00 경 전주시 완산구 C에 있는 D 사무실에서 피해자 E(49 세) 의 상해 행위에 대항하여 쓰고 있던 모자 차양으로 피해자 E의 이마를 3회 치고, 계속하여 손으로 피해자의 멱살을 잡아 흔들고, 이어서 왼쪽 무릎으로 피해자의 오른쪽 무릎을 1회 찼다.
