1. The defendant's KRW 12,00,000 for the plaintiff and 5% per annum from January 7, 2020 to June 19, 2020, and the following.
Reasons
1.The following facts of recognition are not disputed between the parties, or may be acknowledged in accordance with the purport of Gap evidence 1 to 3, 5, and 6 and all pleadings:
In July 9, 2015, the Plaintiff and C have two minor children among the married couple under the law and their children.
B. The Defendant, despite being aware that C is a spouse, was an illegitimate relationship with C, including a teaching system from March 2019 to September 2019, and a travel abroad once.
2. Determination
A. According to the above fact of recognition that the defendant committed an unlawful act with C, and thereby infringing upon the plaintiff's and C's marital life or interfered with their maintenance and his spouse's right. Thus, the defendant is liable to compensate the plaintiff for mental damage in monetary form.
B. Considering the various circumstances shown in the pleadings of the instant case, such as the scope of liability for damages and the marriage period between the Plaintiff and C, the period, content and degree of the unlawful act committed by the Defendant and C, the influence of the unlawful act on the marital life of the Plaintiff and C, and the actions committed by the Defendant and C after the Plaintiff was discovered, it is reasonable to determine the amount of consolation money to be paid by the Defendant to the Plaintiff as KRW 12,00
C. Accordingly, the defendant is obligated to pay to the plaintiff 12,00,000 consolation money and damages for delay calculated by the rate of 12% per annum under the Civil Act from January 7, 2020, which is the day after the delivery date of a copy of the complaint of this case sought by the plaintiff, until June 19, 2020, which is the day of the decision of this case, and the day after the next day to the day of full payment, to the day of the delivery of the copy of the complaint of this case.
3. In conclusion, the plaintiff's claim of this case is accepted within the scope of the above recognition.
