1. The Plaintiff (Counterclaim Defendant) is jointly and severally liable to the Defendant (Counterclaim Plaintiff) for KRW 45,218,535 and its related amount from March 1, 2016 to March 1, 2017.

A principal lawsuit and a counterclaim shall be deemed simultaneously.

1. Basic facts

A. On August 10, 2009, the Plaintiffs and the Defendant concluded a lease agreement between the Plaintiff (Counterclaim Defendant, hereinafter “Plaintiff”) and the Defendant (Counterclaim Plaintiff, hereinafter “Defendant”) (hereinafter “Defendant”) (hereinafter “Defendant”) (hereinafter “instant store”). The Plaintiff and the Defendant are “instant store”).

3) As to the instant lease agreement (hereinafter “instant lease agreement”), the agreement entered into pursuant thereto is “instant lease agreement.”

The main contents of the lease contract are as follows. Upon entering into this contract, the lessor shall be “A” and the lessee shall be “B”. A down payment of KRW 5 million is paid on August 9, 2009 and the balance of KRW 45 million is paid on August 10, 2009 to A at least 10% of the deposit at the time of this contract, and if the balance agreed is in arrears for at least one week from the payment date of the contract, the down payment shall belong to A without any condition. Article 3 (Term of Lease) The term of the lease contract shall be one year from August 10, 2009 to August 10, 201, and shall take effect by full payment of the lease deposit as prescribed in Article 2 (1).

2) When there is no declaration of termination, extension, etc. of this contract not later than three months prior to the expiration of the term of lease, A and B may invite re-contractors three months prior to the expiration of the contract for the permanent lease of the store. The monthly rent of KRW 5,500,000 per month shall be paid to the place designated by A by the 10th day of each month.

(B) If the rent and maintenance expenses are in arrears for at least two months, 5% per month shall be added to the total amount of the rent added to the late payment charge per month (hereinafter referred to as “the rent”).
