A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

On November 12, 2015, the Defendant was sentenced to four months of imprisonment with prison labor for larceny in the Daegu District Court, and the execution of the sentence was terminated in the Daegu Detention House on February 18, 2016.

1. Larceny;

A. At around 14:00 on June 14, 2016, the Defendant, at E mobile phone sales stores operated by the victim D (Nam and 44 years of age) located in Daegu-gu, Daegu-gu, (hereinafter “Seoul-gu”), placed one of the mobile phone model of “Tang Galthom 4” mobile phone model equivalent to KRW 20,000 in the market price owned by the victim, who was placed in the display stand, due to his neglect of the victim’s attention, and stolen it.

B. From around 21:00 on June 16, 2016 to around 21:36, the Defendant went to G K K-type room located in Daegu-gu Dong-gu, Daegu-gu. For charging, the Defendant: (a) went to the G-type room; (b) was stolen with three copies of the NHF card owned by the victim, which was located in the victim H (the male age 52) holding one cellular phone of the 500,000 won of the market price owned by the victim H (the male age 52).

C. On June 17, 2016, around 04:07, the Defendant: (a) committed theft with a cell phone of “Aphone 6 flus” amounting to KRW 400,000 in the market price owned by the victim I (Nam, 29 years of age) who was placed in front of the other victim’s cell room located in large-scale Dong-gu, Daegu-gu, Daegu-gu, 550 (Saamdong); and (b) was located in front of the other victim’s cell room.

2. Fraud;

A. On June 16, 2016, the Defendant purchased beverages, tobacco, etc. at the convenience point operated by the Victim J (J, 42 years of age) located in the Daegu-gu, Daegu-gu, Daegu-gu, at around 21:36, and 1-B.

Of the credit cards in the name of stolen-friendly H, as described in the paragraph, presents the NH learning card to the employee as if he were his credit card, and, i.e., continuously settle the total of KRW 17,020, KRW 15,000, KRW 45,000, KRW 3,600, and KRW 80,620, each of which was provided by the same amount.

B. On June 16, 2016, the Defendant: (a) at the Mamaz Business Place operated by the Victim L in Daegu F, around 21:45; and (b) the said 2-A.
