1. As to the Plaintiff B’s KRW 1,318,60 and KRW 318,600 among them, Defendant D shall be KRW 50,000.

1. Basic facts

A. The Plaintiff A is a resident of the E Apartment apartment located in Incheon F (hereinafter “instant apartment”), and Plaintiff A is a member of the Senior Citizens Association of the Korea Senior Citizens Association, Incheon Metropolitan City Association, the Senior Citizens Association of the Korean Senior Citizens Association (hereinafter “instant Senior Citizens Association”), and Plaintiff B is an son of the Plaintiff.

Shed Defendant C is the chairman of the instant center for older persons, Defendant D is the adviser of the instant center for older persons, and Defendant E-House council for older persons (hereinafter referred to as the “Defendant’s representative council”) is the council of occupants’ representatives organized by the occupants of the instant apartment pursuant to the Housing Act.

B. The resolution for expulsion of the members of the center for senior citizens against Plaintiff A and its invalidity (i.e., the instant center for senior citizens) held an executive meeting on March 23, 2010, and the resolution for expulsion of Plaintiff A from the Defendant’s member was adopted with the consent of all the members present (seven of the nine officers present) pursuant to Article 8(2) of the Rules of the center for senior citizens, on the ground that: (a) each regular and monthly meeting held by Plaintiff A on January 15, 2010 and March 16, 2010; (b) the Plaintiff’s abusive and verbal abuse at the general meeting on February 20, 2010; and (c) each meeting took place; and (d) there was a large amount of disturbance because the Plaintiff’s fear was created in the center for senior citizens due to threat to the Chairperson; and (d) the Plaintiff’s member made a resolution to dismiss the Plaintiff A from the Defendant’s member.

B. On April 2, 2010 after the resolution of the board of directors on April 2, 2010, the senior citizen center of this case made a resolution to dismiss Plaintiff A from its members by holding an extraordinary general meeting on April 15, 2010 while the 31st member present at the meeting of 39 members, the senior citizen center of this case made a resolution to dismiss Plaintiff A from its members with the consent of all members present at the meeting.

(hereinafter referred to as the “instant resolution” in total, including the above resolution of the board of directors and the resolution of the extraordinary general meeting. 【Plaintiff A” on April 12, 2010, the Plaintiff filed a lawsuit against the instant center of senior citizens by the court 2010Kahap6341, seeking confirmation of the absence or invalidity of the instant resolution.
