Reasons
Punishment of the crime
[2013Kadan2304] On March 22, 2012, at around 03:00, the Defendant took a new physical fitness card in the name of husband F of E, which was located on the floor of E, which was located on the part of E, and was lockedly under the influence of alcohol in the guest rooms located in Jung-gu Seoul Metropolitan City, Jung-gu, Seoul, and committed each of the following crimes.
1. On March 22, 2012, at around 03:30, the Defendant violated the Fraud and Specialized Credit Financial Business Act: (a) presented the victim’s “Ick” operated by the victim H in Jung-gu Seoul Metropolitan Government, as if the victim was a legitimate user of the said F’s new physical check; (b) made the victim pay the victim a total of KRW 75,000,000, including 5 Mackju and 5 Macju and Macju, and signed and issued the sales slip; and (c) changed the order to change the Macju to the Macju around 03:32 on the same day, the Defendant again presented the said new physical check card to the victim to pay the sum of KRW 185,000,000, and then signed and issued it to the sales slip, and (d) acquired the victim’s property or pecuniary benefits equivalent to the said amount of KRW 185,000,
2. Attempted fraud;
A. On March 22, 2012, the Defendant: (a) around 03:48, at the “Lagle” operated by the Victim K in Jongno-gu Seoul Jongno-gu Seoul J, the said summary;
After ordering an employee M of the main place of origin a total of KRW 170,000,00, such as beer 5 illness, beer, and singing 2-hours, it was attempted to settle the price by presenting it to M as a legitimate licensee of the F’s new physical check in the name of F, but was refused to accept the limit.
B. On March 22, 2012, around 03:57, the Defendant: (a) taken a taxi driving by the victim N in the sub-place of Jongno-gu Seoul Metropolitan Government (Seoul) and arrived at the Non-gu Seoul, Jung-gu; and (b) intending to pay KRW 3,120 of the taxi fare by presenting the said card to the victim as if he/she was a legitimate licensee of the F’s new physical fitness card in the name of the F.
