1. The Defendant’s KRW 42,908,080 as well as 5% per annum from June 30, 2018 to August 13, 2019 for the Plaintiff.

The statutory interest rate under the main sentence of Article 3(1) of the Act on Special Cases concerning Expedition, etc. of Legal Proceedings is governed by the previous provisions regarding the portion arising until May 31, 2019, and is subject to the amended provisions (12% per annum) for the portion arising after June 1, 2019. Thus, the damages for delay calculated at the rate of 12% per annum from the day following the delivery date of a copy of the complaint ( August 13, 2019) to the day of full payment, and the part seeking payment in excess is dismissed.
