The prosecutor appealed too somewhat against the punishment of the court below (2.5 million won).

However, in light of the following: (a) there is no particular change in the sentencing conditions compared with the lower court; (b) there is a need to strictly punish a crime that obstructs the performance of official duties in order to establish a state’s legal order and eradicate the light of public authority; (c) while, on the other hand, there is no other criminal record except for the Defendant who was sentenced two times to a fine for a different offense; and (d) deposit, etc., the lower court’s sentencing is unreasonable

Therefore, the prosecutor's appeal is dismissed.
