1. The defendant,
(a) within five days from the date this ruling became final and conclusive, with respect to annex 2-2 articles;
Reasons
1. Basic facts
A. The background 1) D apartment located in Yongsan-gu Seoul Metropolitan Government (hereinafter referred to as “D”) is an apartment complex consisting of 32 and 600 households newly built on the site of the former F University, and is a private rental housing under Article 2 of the Rental Housing Act. The non-party G Co., Ltd. (hereinafter referred to as “leased”) newly constructed D and started to lease it to occupants (hereinafter referred to as “Lessees”) from January 201.
B) In principle, private rental housing under the Rental Housing Act can be converted for sale in lots at the lapse of five years from the date of lease, and if a lessor and a lessee have agreed, it may be converted for sale in lots from the lapse of two years and six months from the due date of lease. A lessor and a lessee agreed on January 1, 201, which was at the time of the commencement of lease, to the effect that “after the lapse of two years and six months from the commencement of lease, conversion for sale in lots shall be made, and the price of such conversion for sale in lots shall be the arithmetic average of the appraised prices at which a lessor and a lessee request an appraisal, and the appraisal corporation that may request a appraisal by both parties shall be a large corporation within the upper 10 level of sales.” (C) A lessor notified a lessee of the conversion for sale in lots from January 201 to August 13, 2013 who agreed to the conversion for sale in lots from the due date of lease obligation, and requested the appraisal corporation to calculate the sale in lots price of the apartment.
2) On August 30, 2013, H appraisal submitted to the lessor a written appraisal that assessed the total appraised value of 600 households as KRW 2.572.7 billion.
B. A lessee can appraise only the appraisal corporation with the upper 10th of the sales price based on the contract for sale in lots.
