1. Defendant A

(a) The defendant shall be punished by imprisonment for six months;

(b)Provided, That the above sentence shall be imposed for a period of two years from the date this judgment becomes final and conclusive;

Punishment of the crime

1. Defendant A’s sewage supplier is prohibited from re-subcontracting the subcontracted construction work to another person;

Nevertheless, on July 10, 2014, the Defendant: (a) subcontracted the construction work for the construction of the new apartment from Qu Co., Ltd. (the owner of the order for construction to G and B, who will be responsible for the portion of the work; and (b) re-subcontracted the construction work for the construction work for the non-fluored construction to the non-fluored construction and the land for waterproof construction to the non-fluored construction; and (c) from September 1, 2016 to September 1, 2016, the Defendant subcontracted the construction for the non-fluored construction work for the non-fluored construction to the individual constructor, including G and B, who will be responsible for the portion of the work.

2. Defendant M Co., Ltd. committed the same offense as that set forth in paragraph (1) at the time and place set forth in paragraph (1).

3. Any person who intends to carry on construction business except construction works the estimated cost of which is less than 15 million won as construction works falling under the category of business undertaking Defendant B specialized construction works and details of business in such category of business shall register with the Minister of Construction and Transportation by such category of business as prescribed by the Presidential Decree;

Nevertheless, on September 22, 2014, the Defendant, without registering with the Minister of Construction and Transportation, carried out construction business by executing waterproof construction works consisting of 62,936,838 cause of the cost of construction among the “S extension works”, and from that time until August 15, 2016, the Defendant carried out construction business by executing waterproof construction works, the cost of which is at least 15 million won without registering with the Minister of Construction and Transportation over 23 times in total, as shown in the Annex 2 List of Crimes, from August 15, 2016.

4. A person who intends to carry on construction business except construction works, the estimated cost of which is less than 15 million won, among construction works falling under a category of business undertaking specialized construction works and details of business in such category of business;
