1. The Defendant (Counterclaim Plaintiff) KRW 1,723,680,000, respectively, to the Plaintiff (Counterclaim Defendant) and the Plaintiff’s counterclaim from October 29, 2015 to October 2017.
Reasons
A principal lawsuit and a counterclaim shall be deemed simultaneously.
1. Facts of recognition;
A. On October 26, 2006, Seoul Special Metropolitan City, in the course of the urban environment rearrangement project of a G zone, designated the H G zone as an I urban renewal acceleration district and decided and publicly announced the urban environment rearrangement acceleration plan that promotes the urban environment rearrangement project (public noticeJ), and on March 19, 2009, the district was divided into six business districts with “the determination of the I urban renewal acceleration plan and the determination on the first-level modification”, and the district was designated as a G zone with the area of 46,072.3 square meters of the project area in Jung-gu, Seoul.
(Public Notice L, hereinafter referred to as “instant rearrangement project”). The Defendant has been engaging in real estate development business, etc. and has promoted redevelopment projects under the instant rearrangement project.
B. On July 15, 2009, the Plaintiffs were the land within the zone of the instant rearrangement project and the Defendant, and the land owned by the Plaintiffs (hereinafter collectively referred to as “each land”) of Jung-gu Seoul Special Metropolitan City M& 220.5 square meters and N. 43.3 square meters (hereinafter referred to as “the instant land”).
Each sales contract (hereinafter “instant sales contract”) that sells 1/5 shares of each purchase price in KRW 1,915,200,000 for each purchase price (hereinafter “instant sales contract”).
(2) The main contents of the instant sales contract are as follows: (a) the Defendant entered into the contract and received KRW 95,760,000 on the day of the contract as down payment; (b) the sum of KRW 95,760,000 on September 25, 2009, and KRW 191,520,000 on September 25, 2009.
Article 1 (Sales Price and Time) (1) The sale price of the land of this case shall be KRW 1,915,200,000, and the method of payment shall be as follows:
