A defendant shall be punished by imprisonment for one year.
Reasons
Punishment of the crime
1. On December 26, 2012, around December 21, 2012, the Defendant drafted a false complaint with respect to D using a tample with the purpose of having D obtain criminal punishment, at the home of the Defendant in the third floor of Dongdaemun-gu Seoul Metropolitan Government C, and with the purpose of having D obtain criminal punishment.
The written complaint contains that “Defendant D, a party to the complaint, forged the rubber “transfer report” in the house charter contract under the name of E by arbitrarily affixing the rubber seal, and submitted it to the Ansan District Police Station to use the forged contract as evidentiary documents for the existing private document forgery case,” and that D did not have arbitrarily stamped the rubber of “transfer report” in the house charter contract as above. The above contract was written according to the terms of the contract concluded between F and E, and E was entirely received with the rubber of “transfer report” in order to recognize the right to preferential payment of the deposit.
Nevertheless, on December 26, 2012, the defendant submitted a written complaint to the public official in charge of the above complaint to the public official in charge of the name in the public service center of the Suwon District Public Prosecutor's Office located in the Suwon-si Office 711, Ansan-si, Dong-dong, 711.
2. On April 10, 2013, the Defendant: (a) around April 5, 2013, at the office of the Defendant located in the third floor of Dongdaemun-gu Seoul, Dongdaemun-gu Seoul; and (b) drafted a false complaint with respect to D using a black pen for the purpose of having D receive criminal punishment.
A written complaint states that “The Defendant D, the name of E and F, forged the entire housing lease contract in the name of E and F by arbitrarily stating the content thereof, and submitted the forged contract to the Ansan Police Station and exercised it.” In fact D did not have forged the above contract. The above contract was a document prepared in a genuine manner between F and E.
Nevertheless, the defendant, however, is 2013.
