1. The Defendant’s KRW 7,729,010 as well as the Plaintiff’s annual rate of 6% from December 23, 2016 to December 17, 2019, and the following.
Reasons
1. Details of the instant case
A. The defendant is a corporation established for the purpose of running a business to promote joint interests of C Trucking Business Operators, and the plaintiff worked as an employee of the Financial Cooperative under the defendant's control from February 20, 2006, and retired on April 25, 2016.
B. The contents of the Defendant’s provision regarding the instant case are as follows: (a) Passenger Transport Service Act (hereinafter “passenger Act”); (b) Defendant’s benefit provision; (c) articles of association; (d) mutual aid provision; and (e) personnel service
(1) Passenger transport service providers may establish an association (hereinafter referred to as the "association") with authorization from the Mayor/Do Governor for the sound development of passenger transport service and the elevation of the status of passenger transport service providers.
(2) A cooperative shall be a corporation.
Article 59 (Federations) (1) In order to achieve the common objectives, a cooperative may establish a federation (hereinafter referred to as "federation") with the approval of the Minister of Land, Infrastructure and Transport.
Article 60 (Mutual Aid Activities Performed by Associations and Federation) (1) Cooperatives and federations may carry on mutual aid activities with permission from the Minister of Land, Infrastructure and Transport, as prescribed by Presidential Decree.
(2) Articles 61 (5), 63, 64 (excluding subparagraph 7 of paragraph (1)) and 65 through 68 shall apply mutatis mutandis to contributions for mutual aid activities referred to in paragraph (1), operating committees, scope of mutual aid activities, mutual aid regulations, reporting and inspection, improvement orders, sanctions against executive officers and employees of the Federation or associations which manage and operate mutual aid activities, maintenance of integrity, etc.
Article 61 (Establishment, etc. of Mutual Aid Association) (1) Passenger transport service providers (excluding terminal operators; hereafter the same shall apply in this Article) shall provide support to enable association members to carry out independent economic activities through a mutual cooperative organization and shall compensate for the losses caused by motor vehicle accidents of members of the association.
