Punishment of the crime

The Defendant is a person who opened an Internet camera (C) and advertised a Hand-phone photograph affixed with a forged trademark, posted it, and sells the said article to many and unspecified persons who reported and contacted it.

피고인은 2013. 8. 27.경 청주시 흥덕구 D빌라 204호에서, 상표권자 루이비똥 말레띠에의 등록상표(상표등록번호 제0631194호)와 유사한 모양의 위조 상표가 부착된 핸드폰케이스 1,102개, 상표권자 샤넬의 등록상표(상표등록번호 제0304800호)와 유사한 모양의 위조 상표가 부착된 핸드폰케이스 494개, 상표권자 구치오구치쏘시에떼퍼아찌오니의 등록상표(상표등록번호 제0912201호)와 유사한 모양의 위조 상표가 부착된 핸드폰케이스 351개, 상표권자 프라다 에스 에이의 등록상표(상표등록번호 제0723187호)와 유사한 모양의 위조 상표가 부착된 핸드폰케이스 83개, 상표권자 엠체엠홀딩아게의 등록상표(상표등록번호 제0148830호)와 유사한 모양의 위조 상표가 부착된 핸드폰케이스 184개, 상표권자 헤르메스 앵떼르나씨오날의 등록상표(상표등록번호 제0632660호)와 유사한 모양의 위조 상표가 부착된 핸드폰케이스 52개, 상표권자 버버리 리미티드의 등록상표(상표등록번호 제0497230호)와 유사한 모양의 위조 상표가 부착된 핸드폰케이스 17개 총 2,283개를 판매할 목적으로 보관하여 위 상표권자들의 상표권을 침해하였다.
