Summary of Grounds for Appeal

Although the Defendant alleged misunderstanding of facts as the head of the UAE branch of the Victim C Co., Ltd. (hereinafter “victim Co., Ltd.”) withdrawn the funds of the Victim Co., Ltd for the purpose of fund management, the Defendant did not arbitrarily use the funds for personal purposes, the lower court which found the Defendant guilty of the facts charged of this case has erred by misapprehending the facts and adversely affecting the conclusion of the judgment.

Imprisonment with labor (one year of imprisonment) imposed by the court below on the defendant is unreasonable.
