Reasons
1. The facts below the basic facts do not conflict between the parties, or can be acknowledged in full view of the whole arguments in Gap evidence Nos. 1, 6, 30-7, Eul evidence No. 1-5, 2-8 through 13, 16, 17, and Eul evidence Nos. 3-1 and 5.
The Defendant is a non-corporate group comprised of representatives from each Dong of B Apartment, which is a multi-family housing of at least 500 households in Chuncheon City (hereinafter “instant apartment”). On July 25, 2013, the Plaintiff was elected from the fourth period (term of office from July 26, 2013 to July 25, 2015) of the instant apartment (hereinafter “instant election”) to the representative of the election for each Dong (hereinafter “instant election”), from 112,113 Dong (hereinafter “six constituency”), and was elected by the council of occupants’ representatives around August 3, 2013 and performed its duties.
B. Around February 5, 2014 and February 19, 2014, some of the occupants of the instant apartment complex requested the council of occupants’ representatives, etc. to take the procedure of dismissal against the Plaintiff on the ground that “the Plaintiff demanded or received money and valuables in connection with the re-contract for the childcare center in the instant apartment complex.” Around March 31, 2014, the council of occupants’ representatives publicly announced that “the Plaintiff was immediately dismissed on the day without any specific procedure of dismissal pursuant to the instant management rules (hereinafter “the instant management rules”)” pursuant to the proviso of Article 20(1), Articles 20(1)1, 6, and 7 of the Management Rules.
C. At the time of June 11, 2014, D (hereinafter “D”) appointed five election management members (hereinafter “election management members”) pursuant to Article 50-2 of the Enforcement Decree of the Housing Act and Article 34 of the instant management rules.
On September 19, 2014, D announced that it will hold a residents' meeting to discuss matters, such as dismissal of members of the council of occupants' representatives, etc. on September 25, 2014. Accordingly, D is outside of E at the residents' meeting held.
