A defendant shall be punished by imprisonment with prison labor for up to six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

피고인은 2013. 1. 24.경 광주 북구 C에 있는 피해자 D의 집에서 피해자에게 “전 시댁과 땅 문제로 재판 중인데 그 비용이 필요하다, 500만 원만 빌려 주면 갚아주겠다.”라고 말하였다.

그러나 사실 피고인은 전 시댁과 민사 소송 중이 아니었고, 당시 특별한 재산이 없었던 반면 5,000만 원의 채무를 부담하고 있었던 상황에서 사채업자로부터 변제 독촉을 받게 되자 피해자로부터 받은 돈으로 사채를 해결하려는 계획이었을 뿐 피해자로부터 돈을 빌리더라도 이를 변제할 의사나 능력이 없었다.
