1. On February 12, 2015, the disposition that the Defendant rendered to the Plaintiff on February 12, 2015 as bereaved family benefits and funeral site pay is revoked.
2. The costs of lawsuit shall be.
Reasons
1. Details of the disposition;
A. The Plaintiff is the spouse of the deceased B (Cres, male, and the deceased).
B. From March 2009 to the next death, the Deceased worked as assistant instructors in charge of basic and government classes, college administration general (201), education, research, school affairs support, etc. (201, 201, 201, 2013) at D University (hereinafter “university”).

On November 11, 2013, the Deceased was working at the morning and left the hospital, and returned to her home after receiving the hospital treatment. The Deceased was under intensive treatment for 14 days in the middle-term patient room, but was under intensive treatment at around 22:30 on November 25, 2013.
On February 12, 2015, the Plaintiff, a bereaved family member of the deceased, claimed for the payment of bereaved family benefits and funeral expenses to the Defendant, but the Defendant rendered a site pay disposition (hereinafter “instant disposition”) on the ground that there is no proximate causal relation between the deceased’s death and his/her duties.

2. Whether the instant disposition is lawful
A. Before November 201, 2013, the Plaintiff asserted that he/she carried out the duties jointly with two teaching assistants on his/her own. Specifically, he/she opened and operated a subject at a university level to high school students for scientific talents, took charge of giving lessons to college students, or of managing tools used for physical experiment and practice, safety education, inspection, etc.
The Deceased retired from the University as of August 30, 2013 due to excessive work.
