A defendant shall be punished by imprisonment with prison labor for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date of the final judgment.

Punishment of the crime

[Basic Facts] After having become aware of B (n, 42 years of age) around 2012, the Defendant knew that B was a person with a intellectual disability of Grade B in around 2017.

피고인은 2018. 9. 15. 21:00경 지적장애 2급 판정을 받은 피해자 B(여, 42세)으로부터 ‘집에서 못살겠으니 데려 가달라’는 취지의 전화를 받고, 그 무렵 삼척시 근덕면 동막리에 있는 ‘양리교’에서 피해자를 만나 동해시 C에 있는 피고인의 주거지로 데려가 하룻밤을 재우고, 이튿날 동해시 D에 있는 ‘E식당’에 데려가 일을 하게 한 후, 다시 위 B을 동해시 F아파트에 있는 피고인의 지인 G의 주거지에 데려가 2018. 9. 17. 08:00경 경찰관이 실종신고 된 피해자를 발견할 때까지 약 3일 동안 피해자를 보호하였다.

2. On September 27, 2018, the Defendant forged a private document: (a) presented “A” prepared in advance in the vicinity of the residence of H at Sam-si, Sam-si, B; (b) read and use the Korean language as Grade 2 intellectual disability; (c) “B who is unaware of what the said revocation source is a document; (d) is not subject to punishment; and (e) written in another paper prepared in advance; and (e) stated B’s use as “B” in the name column, “I” in the resident registration number column, and “I” and the guardian column, “K” and “K” in the relation column of guardian; and (e) make it possible for B to read and use the Korean language as Grade 2; and (e) make it possible for B to make the “mental grade 2,” “the date of cause for revocation,” and “the date of preparation,” and “the date of preparation,” in the family name column by disability type.
