A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On November 9, 2007, the Defendant is a person who received living, medical care, or housing benefits as a recipient of basic livelihood security because he/she has no income while raising two children from the vice-market around November 9, 2007.

A beneficiary shall report to the competent assistance agency without delay when the details of a contract for residence, composition or lease of a household are changed, matters concerning the income and property of a person entitled to benefits, household characteristics, etc. are changed, and shall not receive benefits by deceit or other unjust means.

Nevertheless, the Defendant, from March 5, 2014 to December 20, 2016, received benefits of KRW 37,524,354 in total over 96 times in total from around 2016 to around December 20, 2016, on March 20, 2014, without notifying the Korea Rural Community Center of the fact that the composition and income of the households, such as maintaining de facto de facto marital relationship of KRW 1,00,000 or more per month, while maintaining a de facto marital relationship of KRW 306,00 or more per month, was changed.

As a result, the Defendant received benefits by fraud or other improper means.
