1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

1. Basic facts

A. The Defendant is an organization established under the National Sports Promotion Act, and the incorporated association B (hereinafter “B”) is a member group of the Defendant.

B. On August 4, 2016, B delegated the authority to appoint executive officers to B by a resolution of the representatives’ general meeting. On August 12, 2016, B appointed the Plaintiff as B Vice-Chairperson and requested the Defendant to authorize the appointment.

However, on August 23, 2016, the defendant rejected the admission against the plaintiff.

Article 5 (Business) (1) of the Articles of Incorporation of the Defendant (Defendant) shall carry out the following business in order to achieve the purpose prescribed in Article 3:

1. Organizations listed as members of the Sports Council, and organizations listed in Article 7 (1) 1 to guide and support the business and activities of the City/Do Sports Council may join as members, and members' organizations listed in the member categories shall be classified into regular members' organizations, associate members' organizations, and recognized organizations;

Article 10 (Rights and Duties of Members' Organizations and City/Do Sports Council) (2) Members' sports organizations and City/Do Sports Council shall have the following duties in relation to the Sports Council:

1. Duties to comply with the articles of association, regulations, and matters subject to resolution at a general meeting of the Sports Council. Article 12 (Audit and Disciplinary Action against Members' Organizations, City/Do Sports Association, and City/Do Sports Association) (2) The Sports Council may investigate and inspect all of its member trade associations, City/Do Sports Association, City/Do sports associations, and City/Do sports associations, and request them to submit relevant data;

(5) The Sport and Olympic Committee may request a disciplinary action to determine the level of specific disciplinary action against any executive or employee who has misconduct as a result of the investigation and inspection conducted under paragraph (2).

In such cases, the relevant organization shall comply with the request for disciplinary action against the Sports Council.

Article 39 (Executives, etc. of Organizations of Members) (1) Executive officers of organizations of member categories shall be appointed through an election under the articles of association of the relevant organizations.

Article 41 (Relation, etc. to Executives of City/Do Sports Association) (1) Public officials, such as Mayor/Do Governor, superintendent of education, and vice superintendent of education, shall be executive officers of City/Do Sports Association.
