1. As to each real estate listed in the separate sheet:
A. A contract of gift dated March 4, 2015 entered into between C and the Defendant.
Reasons
1. Basic facts
A. The plaintiff filed a lawsuit against C (former name: D) for divorce and consolation money of 2006Ddan2310, and on November 6, 2006, the "C" shall pay 37,000,000 won to the plaintiff until May 6, 2007. If the above amount is not paid by the payment date, the agreement was concluded to pay the unpaid amount in addition to delay damages at the rate of 12% per annum from May 7, 2007 to the date of full payment.
B. On August 9, 2016, the Plaintiff filed a claim against C.
In a claim for the extension of extinctive prescription of the case described in the claim, the same court filed a claim for solatium 2016da2371, and in the lawsuit above, the conciliation was concluded that “C shall pay 35,000,000 won to the Plaintiff until October 31, 2017. If the above amount is not paid by the payment date, it shall be paid in addition to the interest rate of 15% per annum from the date following the date of payment to the date of full payment.”
C. On March 4, 2015, C donated each real estate listed in the separate sheet (hereinafter “instant real estate”) to the Defendant (hereinafter “instant donation”), and completed the ownership transfer registration (hereinafter “instant ownership transfer registration”) on March 5, 2015 under the receipt of the 1874 registration office of the Yancheon Branch of the Gwangju District Court (hereinafter “instant real estate”).
Meanwhile, on the other hand, on December 27, 2005, C had completed the registration of establishment of a mortgage on the instant real estate to E as the receipt of the 11426 registry office of the 2005 Gwangju District Court, but the Plaintiff filed a lawsuit against E for cancellation of the right to collateral security under the 2017Kadan73577, the said court rendered a judgment against E on April 10, 2018, that “E shall implement the procedure for cancellation of the registration of establishment of a collateral security on the instant real estate with respect to “E” on December 27, 2005, which was completed as the 11426 registry office of the 11,426 receipt.
