A defendant shall be punished by imprisonment with prison labor for up to six months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

피고인은 2018. 9. 4. 23:40 경 서울 금천구 C에 있는 D 정형외과 202호 병실에서 입원 치료를 받던 중, 인근 편의점에서 몰래 술을 마셔 만취한 상태로 병실로 돌아와 위 병실에 함께 입원 중이 던 피해자 E(19 세 )에게 별다른 이유 없이 화를 내며 “ 나이도 어린 것이, 내가 너한테 아저씨 뻘이야 ”라고 소리치면서 위 병실에 비치되어 있던 위험한 물건인 선풍기를 피해자에게 집어던져 피해자를 폭행하는 동시에 위 병원 원무과 소속 직원인 피해자 F가 관리하는 시가 36,900원 상당의 위 선풍기를 위와 같이 집어던져 병실 바닥에 부딪혀 부서지게 함으로써 다른 사람의 재물을 손괴하였다.
