(b) Adjudication on expropriation by the Regional Land Tribunal of Incheon Metropolitan City on January 20, 2014 - Land owned by the Plaintiffs and obstacles to expropriation: The date of commencement of expropriation - Compensation for losses on March 16, 2014: The same shall apply to the description in the column for the assessment amount of the adjudication on expropriation on the attached list.
(c) The Central Land Tribunal’s ruling on July 17, 2014 - Details of the ruling: The increase in compensation for some plaintiffs (based on recognition), as shown in the column for appraisal amount of the objection in the attached list, shall be the purport of the entire pleadings and arguments, as stated in the separate sheet.
2. The assertion and judgment
A. Since the plaintiffs' assertion of this case and its ruling of acceptance of this case were unfairly underassessment of the land and buildings owned by the plaintiffs, the defendant should pay the difference between the compensation for losses and the compensation for losses under the court's appraisal.
B. Determination 1) Each description of Eul evidence Nos. 1, 3, and 12 (including those with serial numbers), the result of the commission of appraisal to the appraiser AP (hereinafter referred to as "court appraiser") and the result of the appraisal are "court appraisal". In full view of the purport of the entire pleadings, the court’s appraisal of this case appears to have no illegality or error in the assessment method or price assessment, and in such a case, it is subject to the discretion of the fact-finding court that employs either of the appraisal at the time of the expropriation ruling or objection ruling or of the court’s appraisal (see, e.g., Supreme Court Decision 2003Du10145, Feb. 27, 2004). As such, the amount of compensation shall be determined according to the result of the court’s appraisal of the subject matter
