1. The Defendants: (a) each of the Plaintiff KRW 106,744,467 and KRW 48,406,276 among the Plaintiff, respectively, from July 7, 2009 to 17,400.
Reasons
1. Basic facts
A. The status of the parties (1) Defendant Gwangju Metropolitan City is a local government that takes charge of planning the construction of access roads B (hereinafter “instant access roads”) and executes the construction of the State-funded local highway C Road (hereinafter “State-funded local highway C”).
(2) The Korea Highway Corporation is an institution that executes construction works of access roads of this case from August 2008 to November 2009 pursuant to an agreement with Defendant Gwangju Metropolitan City.
(3) The Plaintiff is a person who, from around 2002, operates a flowers farm in Gwangju Mine-gu D and E, cultivating spawres (hereinafter “instant farm”).
B. The farm of this case was flooded (hereinafter “the first flood of this case”) by concentrating the level of 196.0 meters of the rainfall on July 1, 2009 on July 1, 2009 at the Flux of Gwangju Mine-gu where the farm of this case was located, and the farm of this case was flooded (hereinafter “the first flood”), and even on July 11, 2010, the daily rainfall of 191.0 meters of the rainfall of 191.0 meters was flooded.
