A Imprisonment with prison labor for a year and two months, Defendant B and C shall be punished by imprisonment for a period of ten months, Defendant D, E and F, respectively.
Reasons
Punishment of the crime
Defendant
A has established and operated a gambling site (hereinafter referred to as “L site of this case”) stating that, if gambling members are engaged in hosting their members on the scambling of a foreign axis, camping district, and farming-gu game from March 7, 2014 to June 27, 2014, they would deposit dividends to gambling members according to the dividend rate, and Defendant D, E, B, and C was a member of the organization of Defendant A.
1. Defendant A’s violation of the National Sports Promotion Act and the opening place of gambling in this case are operators of the instant gambling site. From March 7, 2014 to June 27, 2014, in collusion with D, E, B, and C, Defendant A deposited KRW 734,169,920 in the gambling account, as shown in the attached Table of Crimes (A), and deposited money of KRW 734,169,920 among them into the gambling account, and deposited the money with dividends in accordance with the dividend rate, and the remaining money was deposited into the instant gambling site’s business. From March 7, 2014 to June 5, 2014, Defendant A deposited the money into the instant gambling site’s 2nd floor of M&L in the Republic of Korea, from June 6 to June 27, 2014, and deposited the money into the Busan Do 150,000 and 14,000 local transportation account.
Accordingly, the Defendant, in collusion with D, E, B, and C, committed an act of providing property or financial benefits to a person who correctly predicted the outcome by issuing sports betting tickets or similar things from March 7, 2014 to June 27, 2014, and at the same time, opened a gambling place for profit-making purposes.
2. Defendant D and E’s violation of the National Sports Promotion Act and the Defendants of gambling openings are the members of the instant gambling site, who are the instant gambling site operators, in collusion with A, and are the members of the instant gambling site from March 7, 2014 to May 8, 2014 (D, E).
