A defendant shall be punished by imprisonment for not more than ten months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
The defendant is a reporter of a female tree in C, who has prepared articles about trends in a female water area, safety accidents, environmental problems, etc. in a female national industrial complex, or has been engaged in the management of editing articles.
In preparing articles or editing them, the defendant, who is in the above position, has a duty not to obtain unjust enrichment or receive preferential treatment, convenience, money, or other valuables, etc. in relation to his/her duty by using his/her own status.
1. On June 27, 2005, the Defendant acquired KRW 59,156,900 in total 14 times in return for the foregoing illegal solicitation, as described in the attached Table 1 Nos. 1 through 9, 11 through 15, from the date of November 10, 2009, from the point of view of receiving 3,30,000 won for individual advertising expenses, in exchange for the foregoing illegal solicitation, on the ground that the Defendant is a reporter’s identity, in response to the illegal solicitation from related parties in charge of the press of D, a business entity located in the leisure industrial complex.
2. On August 25, 2005, the Defendant acquired KRW 54,450,000 in total on 17 occasions in return for the foregoing illegal solicitation from August 18, 2009, from around August 17, 2009, from the point of view that he received illegal solicitation from a person in charge of press’s name in return for an impliedly negative news from a person in charge of press’s name, on the ground that he is the reporter’s identity, and received KRW 4,769,600 as a joint advertising expense, from that time to August 18, 2009.
Even if there was no specific pending issue, it is recognized that it was an illegal solicitation contrary to social rules and the good faith principle, even if there was no specific issue to request impliedly the provision of money from companies in the national industrial complex as advertising expenses.
