A defendant shall be punished by imprisonment for not less than eight months.
Reasons
Punishment of the crime
1. Fraud;
A. On July 28, 201, the Defendant, at the “D Company Office” operated by the Defendant located in Mapo-gu Seoul Mapo-gu Seoul metropolitan building 602, reported a newspaper advertisement “D Company Office’s 20 or more countries exported to the 20 or more countries in the world E market, agency branch, etc.” and suggested the Defendant to the victim F, who had asked about the Defendant, about the prospects of air-to-door business and the total amount of local market investment, and made a proposal regarding the Defendant’s investment in the E market, “20,000,000 won as security deposit and the total amount of KRW 30,00,000 as well as KRW 10,00 in cash or in cash after six months.” If the agent is not recruited, the Defendant would make a contract to enter into the E Air Business Secretariat’s entire Seoul and the Gyeonggi-do North Korean total market. If the agent is not recruited, 20,000 won will return in cash after six months, and the amount of goods will also be equivalent to six months or in cash.”
However, there is no fact that the said E-mail has exported more than 20 countries around the world, and the Defendant had no intention or ability to pay cash or goods equivalent to KRW 30,000,000 after six months due to economic difficulties, such as not being well-grounded in the said business from August 2010.
Around August 3, 2011, the Defendant, by deceiving the victim, received KRW 30,000,000 from the victim to the new bank account in the name of G company.
B. On August 26, 2011, the Defendant made a proposal for the victim F’s “D company office” operated by the Defendant located in Mapo-gu Seoul Mapo-gu Seoul Metropolitan Government C building 602 on air clean business prospects and regional total investment, and made it possible for the Defendant to open a regional total board.
In particular, more than 30,000,000 won is invested and a total of 60,000,000 won is made, the entire sales rights is given to the Seoul, Gyeonggi, and Incheon all regions, and a corporation is established within one month to be appointed as a registration director, and a corporation card and equity is 10%.
Even if 120,00 agencies are recruited, the principal may be recovered and shall not be recruited.
