그럼에도 불구하고 피고인들은 함께 성매매 업소를 운영하기로 공모하고, 2018. 12. 초경부터 2019. 2. 26.경까지 대구 중구 E에 있는 오피스텔인 ‘F’의 G호, H호, I호, J호, K호, L호에서 ‘M'라는 상호로 성매매 업소를 운영하면서 피고인 A은 위 오피스텔에 침대를 비롯한 비품을 구비하고, 피고인 B는 위 오피스텔 중 J호, K호를 자신의 명의로 임차하여 제공하고 외국인 성매매 여성 종업원 모집 및 관리를 담당하고, 피고인 C은 ‘매니저’로서 위 오피스텔에 상주하면서 성매매 여성 종업원들의 스케쥴을 관리하면서 성매매 여성 종업원들의 프로필 사진을 편집한 후 유흥업소 소개사이트인 ‘N’ 등에 광고를 게시하여 그 광고 등을 보고 연락해 온 불특정 다수의 남성들로부터 성매매 대금 명목으로 코스별로 1회에 10~26만 원을 지급받고 위 오피스텔에서 위 성매매 여성 종업원들과 성교행위를 하게 하였다.
