Defendants shall be punished by a fine of KRW 4,000,000.

If the Defendants did not pay each of the above fines, 50.

Punishment of the crime

Defendant

B is an employer who employs 20 full-time workers on the trade name of the 4th floor in Daegu-gu W 401, and runs a salary-making business. Defendant A is the father of the above B, who is a joint employer of the above business.

1. An employer who violates the Minimum Wage Act shall pay workers wages exceeding the minimum wage amount. From January 1, 201 to December 31, 2010, hourly 4,110 won, hourly 4,320 won from January 1, 201 to December 31, 2011, hourly 4,580 won from January 1, 201 to December 31, 201, hourly 4,860 won from January 31, 201, and hourly 4,580 won from January 1, 2012 to December 31, 2012.

Nevertheless, from January 201 to November 2012, the Defendants paid workers E an hourly wage of KRW 2,490 which is less than the minimum wage amount at the same workplace from the above workplace from around January 2010 to November 201, and paid workers 9 an hourly wage of KRW 2,200 to KRW 3,500 which is less than the minimum wage amount as stated in attached Table I.

As a result, the Defendants conspired to pay wages below the minimum wage amount to workers.

2. When a worker dies or retires, the employer in violation of the Labor Standards Act shall pay the wages, compensations, and other money or valuables within fourteen days after the cause for such payment occurred.

Nevertheless, the Defendants worked from July 4, 2006 at the above workplace and did not pay Y's wages of 15,286,750 won to retired workers on April 1, 2012 within 14 days from the date of retirement without any agreement on the extension of the due date.

As a result, the Defendants conspired to pay wages and other money or valuables within 14 days from the date of their retirement.

3. An employer who violates the Guarantee of Workers' Retirement Benefits Act shall, in case where a worker retires, pay the retirement allowance within fourteen days after the cause for such payment occurred; and

Nevertheless, the Defendants were working from July 4, 2006 at the above workplace.
