Reasons
Punishment of the crime
[Criminal Power] On January 10, 2019, the Defendant was sentenced to two years of imprisonment for fraud in the Seoul Southern District Court, and completed the execution of the sentence in the military prison on March 29, 2020.
【Criminal Facts】
[200 Highest 290] On May 4, 2020, the Defendant stopped a taxi operated by the victim C on the front road of Seocheon-si, Seoul Special Metropolitan City on May 4, 2020, and concluded that “The agreement amount is urgently needed due to a bicycle and a traffic accident. It will be paid by adding up the case expenses within a few hours on the face of the transfer.”
However, there was no traffic accident on the day, and there was a plan to use money as gambling funds from the victim as agreed money, and even if the victim received money from the victim, there was no intention or ability to pay it.
Nevertheless, the Defendant: (a) by deceiving the victim as above, received 60,000 won from the Defendant’s Nonghyup Bank account (D) to the Defendant’s Nonghyup Bank account; and (b) from June 8, 2020 to June 8, 202, the Defendant received delivery of KRW 6,886,00 in total from the victims over 12 times in the same manner as indicated in the attached Table 1 of Crimes List 1.
[2020 Highest 374] On June 7, 2020, the Defendant made a false statement to the F convenience store located in Gwangju Dong-gu, Gwangju, about 02:00, stating that “The amount of agreement is urgently needed due to the occurrence of a traffic accident” to the victim G who was part-time in the Gu-gu, Gwangju, the Defendant would be repaid at approximately three hours after lending money.”
However, there was no traffic accident on the day, and the defendant was planning to use money as gambling fund from the victim as agreed money, and even if the victim received money from the victim, there was no intention or ability to pay it.
Nevertheless, the defendant deceivings the victim as above and belongs thereto from 02:07 to 03:54 on the same day.
