Punishment of the crime

Defendant

A is the representative director of the agricultural corporation B in the former Uan-gun C, and the defendant corporation B is the corporation with the purpose of manufacturing the fruit and the reduced food industry.

1. Defendant A

(a) No business operator who operates discharging facilities, etc. in violation of the Act on the Conservation of Water Quality and Aquatic Ecosystems shall discharge water pollutants that flow into prevention facilities without passing through the final outlet for discharge or install facilities capable of releasing water pollutants without passing through the final outlet for discharge;

Nevertheless, on October 15, 2015, the Defendant did not flow about 8.06 tons of wastewater generated by the cutting of kimchi and washing, etc. at the place of business of B, which is a facility for discharging wastewater in the above wastewater, into a water pollution prevention facility, and temporarily stored it in the inside septic tank, and discharged it without permission through pump transfer pipes through the pump transfer pipes.

(b) Any person who intends to collect, transport, store, or dispose of wastes shall ensure that wastes are not scattered or leaked in the course of collection, transportation, or storage, and that the water is not leaked;

Nevertheless, on October 15, 2015, the Defendant did not take measures to prevent the divulgence of water in the process of keeping wastes, such as the waste drilling, in the place of a company B around the same o'clock, in the process of keeping such wastes in the base straws, and thereby leaked water flown into a nearby water channel.

2. The Defendant Company B, an employee of the Defendant Company, discharged wastewater without permission, or discharged water from the Defendant without permission, as described in paragraph (1), with respect to the Defendant’s business.
