1. The Defendant’s KRW 61,59,839 and KRW 27,604,119 among the Plaintiff and the Plaintiff’s KRW 27,604,119 shall be from March 21, 2013 to April 14, 2014.

1. Basic facts

A. On July 23, 2010, the Plaintiff entered into a contract with the Incheon Regional Government Procurement Service for the supply of materials for landscape lighting with respect to the electrical construction of the public design creation project, which is the Foundation (hereinafter “the Foundation”), to the extent of November 30, 2011, regarding the supply period of materials for landscape lighting, including the contract amount of KRW 521,524,00,000, and the delivery period of such materials.

The Plaintiff and the Incheon Regional Government Procurement Service reduced the instant contract amount to KRW 374,220,00 on August 26, 201, and KRW 370,60,000 on August 31, 201, respectively, and extended the delivery period on February 19, 2013 to March 20, 2013.

C. The Plaintiff received KRW 22,60,000 from the Incheon Regional Government Procurement Service on February 8, 201 as the price of supply after delivering part of the government-funded materials to the instant foundation, and received KRW 209,075,880 on December 23, 201 as the price of supply from the Incheon Regional Government Procurement Service.

On March 11, 2013, the Plaintiff supplied part of the government-funded materials to the instant foundation, and the unpaid goods price is KRW 27,604,119.

2. Determination

A. On July 23, 2010, the Plaintiff entered into the instant contract with the Incheon Regional Government Procurement Service on July 23, 2010, with the contract amount of KRW 521,524,00 (the final revised amount of KRW 370,60,000) and the delivery deadline until November 30, 201 ( March 20, 2013). The Plaintiff supplied part of the government-funded materials under the instant contract to the Foundation and supplied them total of KRW 231,675,880, in addition to the supply price of KRW 231,67,60,119, the unpaid amount of KRW 27,604,119, in addition to the supply price of KRW 231,675,80, in total from the Incheon Regional Government Procurement Service. In full view of the purport of the statement and pleading of evidence No. 23, the tender rules applicable to the instant contract and the general rules established under the instant contract (hereinafter “instant general rules”).
