Reasons

Punishment of the crime

The defendant is a user who is engaged in the business of manufacturing communications equipment by using four full-time workers as the representative director of Geumcheon-gu Seoul Metropolitan Government Building 1105.

(a) An employer in violation of the Labor Standards Act shall, if a worker dies or retires, pay the wages, compensations, and all other money or valuables within fourteen days after the cause for such payment occurred;

Provided, That in special circumstances, the date may be extended by mutual agreement between the parties.

Nevertheless, the defendant stated in the facts charged on April 1, 2008 in the above workplace as of May 1, 2008, but seems to be a clear clerical error.

From March 31, 2012 to March 31, 2012, E did not pay KRW 43,277,810 in total for the same working period from the date of retirement to 14 days from the date of retirement without an agreement between the parties on the extension of the payment period.
