1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. The Defendant is a company primarily responsible for the export, import, packing, and sale of feed and raw materials for feed, and is a U.S. child from March 2013.
The Alfalfa Hayth of Alphythy was imported from the C (hereinafter referred to as the "C") located in No. B.
B. C begins on March 7, 2013, on the 106.521M, 106.58MT, 106.758MT, 28.612MT on the 21st of the same month, on the 106.521M, 106.758MT, and 106.6.12MT on the 28th of the same month;
4.4. 106.62MT, each of the plaintiffs, was loaded to the plaintiff's operated vessel as the carrier, and the defendant paid the above amount through the credit opened by the financial institution on five occasions.
C. On April 11, 2013, C also loaded a total of 106.876MT loaded on five container Alphphm 40 feet Hagh Cube container (hereinafter “instant cargo”) on the Plaintiff’s (D) vessel, and the instant cargo arrived at the luminous port on the 29th day of the same month.
On May 14, 2013, the Defendant, via the World Customs Service, requested the Plaintiff to approve the electronic delivery order at the Plaintiff’s mining concession point along with the bill of lading (number E, No. 11, hereinafter “instant bill of lading”). The Plaintiff’s officer asked Defendant G employees of the Defendant about the source of the said bill of lading on the ground that the terms and conditions are not printed on the back of the above bill of lading and there is no endorsement by the bank related to the letter of credit. After confirming that G was received by mail, the Defendant received all of the three copies of the bill of lading issued, and delivered the instant cargo to the Defendant on May 15, 2013.
E. C All three original copies of the instant bill of lading (No. 10, hereinafter “instant bill of lading”) are possessed by themselves, but the Plaintiff delivered the instant cargo to the Defendant without redeeming it with the original bill of lading after July 15, 2013.
