Reasons
1. Basic facts
A. A and B are married couple, and C are children.
B. The Plaintiff entered into an insurance contract with the insured C and the insurance period from September 13, 2010 to September 13, 2025, with respect to the child insurance premium. The main contents of the said insurance contract are as follows:
(2) Article 755 of the Civil Act provides that "the insured or the legal supervisor of the insured under Article 755 of the Civil Act shall be legally liable for any physical disability of another person due to an accident listed below during the insurance period of this special agreement entered in the insurance policy, and thus, the insured or the legal supervisor of the insured under Article 755 of the Civil Act shall be held liable for any damage resulting from the insured or the legal supervisor of the insured under Article 755 of the Civil Act.
1. An accident that happens due to the ownership, use, or management of the house entered in the insurance policy used by the insured for residential purpose;
2. An accident that happens due to the daily life of the insured;
C. The Defendant concluded each insurance contract with A and B as follows, and the content of the above insurance contract is as follows: liability for damages during the daily life (Ⅱ).
(2) On May 8, 2009, the term of insurance contract for the insured who is named as the insured in the insurance policy (hereinafter “Defendant’s insurance contract”).
