A defendant shall be punished by imprisonment for one year.

The defendant shall be ordered to complete a sexual assault treatment program for 40 hours.

Punishment of the crime

1. Violation of the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes (Kameras and photographing);

A. While the Defendant is doubtful of the male relationship between the victim C (n, 54 years old and 54 years old) and the male relationship between the beginning of April 2014 and the end of June 2015, the Defendant sent the video images taken by the victim’s friendship E using a mobile phone at his/her own residence, around 15:21 on July 4, 2015, where the victim was aware of the sexual intercourse between the victim and the victim’s sexual intercourse with the victim’s sexual intercourse with the victim’s sexual intercourse with the victim’s sexual intercourse.

Accordingly, the defendant provided a third party with the body photographing of the victim who could cause sexual humiliation or shame by using a camera or other similar mechanism.

B. On July 11, 2015, at around 23:03, the Defendant transmitted video images with which the victim was exposed to F, who is the offender of the victim, using a mobile phone in his/her own residence, and the victim was using the mobile phone.

Accordingly, the defendant provided a third party with the body photographing of the victim who could cause sexual humiliation or shame by using a camera or other similar mechanism.

2. Intimidation;

가. 피고인은 제1항 기재와 같이 피해자가 헤어지자고 하면서 피고인의 연락을 받지 않자, 2015. 7. 11.경 휴대전화를 이용하여 피해자에게 ‘오늘 재미있게 지내고 오세요 내일부터는 힘든날이 오태니까요’, ‘이것을 먼저 G H F 헌터한태 먼저 보냄니다 즐겨보세요ㅋㅋ 그 다음에는 누구ㅋㅋ’, ‘다음은 I J 한태’, ‘배포하기 전에 연락주세요 사진으로 헌상할려고요’, ‘어떠한 망신이 되는지 기다려 주세요ㅋㅋ’라는 문자메시지를 보내 피해자를 협박하였다.
