나. 강간 범행 ⑴ 피고인은 2016. 12. 중순 16:00 경 당시 중학교 3 학년 (15 세) 인 피해 자가 위 주거지 내 작은방에서 친구와 전화통화하며 의자에 앉아 있는 것을 보고 피해자의 손목을 잡아끌고 안방으로 데려간 후, 피해자의 입에 혀를 넣으려고 하여 피해자가 입을 다물고 몸을 밀치며 저항하자 양손으로 어깨를 잡아 가만히 있으라고 윽박지르듯이 말하여 반항하지 못하게 한 후 피해자의 옷을 모두 벗긴 후 피해자의 음부에 자신의 성기를 삽입하였다.
