Punishment of the crime

피고인은 2017. 9. 7. 00:05 경 위험한 물건인 식칼 2 자루( 칼날 길이 18센티미터, 전체 길이 30 센티미터 및 칼날 길이 11센티미터, 전체 길이 24센티미터 )를 소지한 채 위 피씨방 앞으로 찾아가, 피해자를 밖으로 불러낸 후 피해자에게 사과를 하라고 요구하였으나 피해자가 이에 응하지 않는다는 이유로 “ 죽여 버리겠다” 고 하면서 식칼 한 자루를 뽑아들었고, 피해자가 피고인이 뽑아든 칼을 빼앗으려 하자 상호 몸싸움을 하던 중, 계속하여 다른 식칼을 뽑아들었고, 결국 피해자가 피씨방으로 도망을 가자 양손에 식칼을 쥔 상태로 피씨방 문을 발로 걷어차는 등 피해자의 생명 및 신체에 위해를 가할 듯한 태도를 취하였다.
